Welcome to CharityDOs – Your Connection to Charity Events

CharityDOs.com.au (“the Website”) is an online service operated by CharityDOs Pty Ltd (“CharityDOs”) offering FREE event listing and OPTIONAL ticketing services to help charity and non-profit organisations promote their cause through the development of an online community and use of social media. It is important that you read these Terms and Conditions of Service (the “Agreement “) which form the basis on which you use and access the Website. If you do not agree to this Agreement please do not continue to use this Website.

  1. Your Content and Shared Information
    • You own all of the content and information you post on CharityDOs.com.au and you can control how it is shared through your privacy and application settings .
    • You assume all risks associated with that content, including: anyone's reliance on its quality, accuracy, or reliability; potential intellectual property infringement; or any disclosure by you of information that makes you or others personally identifiable.
    • You are responsible for ensuring that your activities conducted on CharityDOs are lawful.
    • We will use your content in a number of ways on the Website and in the promotion of fuindraising events, including publicly displaying your content and making derivative works of it. This use of your content is exclusively for the promotion of your fundraising event. For that purpose you agree to grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, right to your content.
    • You also grant the users of the Website and any other website which utilises content sourced from the Website the right to access your content in connection with their use of the Website.
  2. Content Guidelines
    • We reserve the right to review and delete uploaded content at any time at our discretion and without notice, particularly if it breaches these guidelines. You should report any suspicious activity or content which you believe breaches these guidelines.
    • You should not post any content or promote any event on the Website that:
      • Is not related to supporting charity or non-profit organisations in Australia.
      • Violates any applicable law, statute, ordinance or regulation.
      • Is hateful, threatening, defamatory, obscene or pornographic; incites violence; depicts nudity or portrays any sexual act; or contains graphic or gratuitous violence.
      • Infringes any third party's copyright, patent, trademark, trade secret or other intellectual property rights.
      • Contains or promotes any alcohol-related or other mature content (including advertisements) without appropriate age-based restrictions.
      • Is a contest, giveaway, or sweepstakes ("promotion") without complying with all applicable laws and licensing requirements.
      • May in any way cause harm to the Website including any reputational or non-economic loss.
      • Includes any unauthorised commercial communications e.g. spam or viruses.
      • Solicit personal information from other users, record information about other users or otherwise breach the privacy of other users
  3. Registration and Account Security
    • You will not use this website unless you are: (a) at least 18 years old; or (b) at least 13 years old and acting under the supervision of a parent or guardian.
    • You will not share your password with anyone.
    • Your password will be not easily identified with your username.
    • You will not provide any false or misleading personal information.
  4. Purchase and Sale of Tickets
    • All tickets are sold by CharityDOs as an agent for the seller responsible for the event and you are subject to the terms and conditions imposed by the seller.
    • While CharityDOs attempts to ensure the accuracy of information provided on the Website, CharityDOs accepts no liability for any loss resulting from access to, use of, or inability to access the Website or its content.
    • Tickets and confirmation of payment will be emailed to buyers.
  5. Specific Provisions for Sellers
    • CharityDOs acts as your agent for selling tickets to your event and you remain responsible for that event and any claims arising out of it under any laws or regulations and for any chargebacks or refunds.
    • If you cancel an event listing you are responsible for any charges incurred until the event listing is removed from CharityDOs.
    • CharityDOs cannot control how people interact with your event listings, and are not responsible for click fraud or other improper actions that affect the cost of running event listings.
    • Any promotional donations provided by CharityDOs only relates to the CharityDOs fee and does not include the credit card processing fee charged by the financial gateway (PayPal).
  6. Payments and Fees
    • Joining the Website and listing charity and non-profit fundraising events on the Website is free.
    • Payments for goods and services purchased from CharityDOs are processed by a secure payment system provided by a third party financial gateway - PayPal. Please refer to PayPal (http://www.paypal.com.au) terms and conditions for further information.
    • Buyers purchase tickets using either their credit card or PayPal account. After completing the payment on the PayPal website, the buyer must wait for the browser to go back to the CharityDOs Website. Failure to do so will result in your ticket not being issued.
    • Payment to the seller is made to an Australian bank account within 5 days of the events' end date. 
    • Credit Card processing fees of 2.6% + 30c per transaction are charged by PayPal and subtracted from the Sellers account.
    • CharityDOs adds a small fee of 50c to purchased tickets, to cover part of the Websites’ operating cost. This fee is added to the ticket price and paid by the Buyer.
    • CharityDOs is not obliged to intervene in any dispute between buyers and the seller and have no liability for any claims, including refund requests.
    • Buyers should contact the seller for any refund claims. CharityDOs does not provide refunds.
    • Before purchasing tickets, the buyer should carefully review the event and ticket selection. Policies set forth by the seller will dictate the issuing of exchanges or refunds after a ticket has been purchased or for lost, stolen, damaged or destroyed tickets. All claims are the sole responsibility of the seller and to the extent permitted by law CharityDOs has no liability to you. (Sellers can initiate the email of replacement tickets from the My DOs section of the Website.)
    • You are responsible and agree to reimburse us for any fees, fines or other liabilities incurred by us (including costs and related expenses) that were caused by or arising out of payments that you authorized or accepted.
    • All prices are inclusive of GST unless otherwise stated. A Tax invoice for purchases will be automatically provided. The seller is responsible for remitting any taxes related to payments they receive.
  7. Privacy Policy
    • Your privacy is important to us. Please refer to the CharityDOs Privacy Policy, available separately on the Website.
  8. Agreement Variation
    • CharityDOs may change the terms of this Agreement at any time. You agree to be bound by this Agreement and any changes to it, each time you use the  Website.
  9. Disputes
    • By doing business with CharityDOs you agree that this Agreement shall be governed by the law and courts of Queensland, Australia.
    • Your sole and exclusive right and remedy in case of dissatisfaction with CharityDOs or any other grievance shall be your termination and discontinuation of access to, or use of the Website.
    • If anyone brings a claim against us related to your actions, content or information on CharityDOs, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.
    • Any dispute in connection with this Agreement, between CharityDOs and you, may be settled by independent, confidential mediation by reference to a commercial disputes centre, at either party's election. You and CharityDOs agree to be bound by the outcome of such mediation. Each party will bear its own costs (and split equally any joint costs) of mediating the dispute.
  10. Miscellaneous
    • The Website, and all other goods and services produced or supplied by CharityDOs come “as is” without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.
    • We do not control or direct users' actions on CharityDOs and are not responsible for the content or information users upload or share on CharityDOs.
    • CharityDOs makes no warranty or representations regarding any company, individual, website or organisation mentioned on the Website.
    • Every provision of this Agreement is intended to be severable. If any section of this Agreement is found to be invalid or unenforceable, then such section will be deemed amended and interpreted, if possible, in a way that renders it enforceable. If such an interpretation is not possible, then the section will be deemed removed from this Agreement and the rest of this Agreement will remain in full force and effect.
